How to Cancel Your UAE VAT Registration

How to Cancel Your UAE VAT Registration

Cancelling VAT registration in the UAE isn’t as simple as deciding to stop. Your reason for leaving decides the route. Deregistration can be mandatory with a strict deadline. It can be optional with conditions. Or it may not be open to you yet. DASA Consulting can help with VAT registration in Dubai and confirm whether you must deregister and by when.

Mandatory Deregistration: When You Must Cancel

A VAT-registered business must apply to deregister if either of these applies:

  • The business stops making taxable supplies entirely and does not expect to make any in the next 12 months, or
  • Taxable supplies over the previous 12 months fall below AED 187,500, the voluntary registration threshold. You also don’t expect to pass it again soon.

This second trigger surprises many businesses. They see falling revenue as a business problem, not a tax one. But once your 12-month taxable supplies drop below AED 187,500 and stay there, you must apply.

The FTA gives you 30 business days from the date the obligation starts to apply. Missing this window does more than delay the paperwork. It brings a separate deregistration penalty, covered below.

Voluntary Deregistration: When You Can Choose To

Any registrant whose taxable supplies sit between AED 187,500 and AED 375,000 may apply to deregister. In that band the choice is yours. If your supplies and expenses both fall below AED 187,500, you must deregister. Voluntary registrants have one extra rule. They must first pass the 12-month lock-in below.

The 12-Month Lock-In for Voluntary Registrants

Did you register voluntarily? Then you can’t apply to deregister within 12 months of your registration date. Changes in your business don’t shorten this. It is the trade-off side of voluntary registration, covered in the guide to the UAE VAT registration threshold. Registering early means at least one year on the VAT register.

Some businesses register voluntarily and then want out fast. Costs dropped, plans changed, or the B2B benefit never came. These businesses need to plan around the lock-in. Deregistration isn’t open to them at short notice.

The Deregistration Process

You apply for deregistration through EmaraTax, the same as for registration. You confirm the reason: you stopped taxable supplies, or you fell below the threshold. The FTA reviews the application before it approves the cancellation. You stay VAT-registered until the FTA approves it. Submitting the form isn’t enough. Keep filing returns as normal until you get confirmation.

Penalty for Late Deregistration

A late deregistration application has its own penalty. It is separate from filing or payment penalties. Table 1 of Cabinet Decision No. 40 of 2017 sets it. The penalty is AED 1,000 once the 30-business-day window passes. Another AED 1,000 follows each month until you apply. The total stops at AED 10,000. Five months late on a mandatory trigger means AED 5,000 in deregistration penalties alone. See UAE VAT penalties guide for the broader penalty picture.

What Happens to Recovered Input Tax After Deregistration

Deregistering doesn’t undo VAT you correctly charged, paid, or recovered while registered. It closes the VAT account from that date on. You still file a final return for the period up to deregistration. It must show the business’s real position. You can’t zero it out because registration is ending.

Final VAT Return and Outstanding Balances

Deregistration triggers a final VAT return up to the approved cancellation date. Any VAT owed for that final period is still payable. Watch the goods and services you still own on the deregistration date. The VAT Law treats them as a deemed supply if you recovered input tax on them (Article 11(4)). This covers stock and other assets, not only capital assets. So you account for output VAT on them in the final return. Review this before you apply. It can change the final amount due by a lot, mainly after big purchases.

Frequently Asked Questions

Can I deregister immediately if my business closes down completely?

Yes. A business that has stopped all taxable supplies for good must deregister. This is a mandatory trigger. Apply within 30 business days. Don’t leave it open.

What if my supplies temporarily dip below AED 187,500 but I expect them to recover?

The trigger is a real, lasting drop with no sign of recovery soon. One quiet period isn’t enough. If you expect supplies to recover, deregistration may be the wrong move. Confirm this first. Don’t decide on one slow month.

Is there a fee to deregister?

Usually there is no government fee for deregistration. VAT registration is free too. Confirm this on EmaraTax when you apply.

Can I re-register for VAT after deregistering?

Yes. If your business meets the mandatory or voluntary criteria again, you can register again. If you pass the mandatory threshold, you must. You go through the full registration process again.
